GUARDIANSHIP

Due to the presence of certain intellectual, developmental, or other forms of disability, an individual may be unable to make his or her own personal and financial decisions. In such situations, Guardianship proceedings for such an individual become a necessity. At Steffy Law P.C., we can assist you with all that is required to apply for Guardianship for your loved ones.

One of the important activities when embarking on Guardianship proceedings is to determine the type and scope of the Guardianship required. We help you in this regard, as well as filing the Guardianship petition, explaining the duties of the guardian and assisting the guardian with annual accountings as mandated by the court.

The Guardianship process typically proceeds under the New York Surrogate’s Court Procedure Act 17-A or Article 81 of the Mental Hygiene Law depending on whether the individual is a child or an adult. The process involves ascertaining the disability of the person in question by means of a Doctor’s report that affirms said disability. The process also involves outlining the specifics of the person’s disability that prevents them from being able to manage their affairs.
